Protection Granted to Railway Transport Employees

As of June 9, 2023, following the amendment of the Railway Transport Act (Article 58a) and the Public Transport Act (Article 49a), representatives of certain professions, while performing or in connection with performing their official duties, are granted the same legal protection as public officials, as provided in Articles 222 and 223 of the Penal Code.

This protection applies to the following positions:

  • Train driver (engine driver)
  • Railway vehicle operator
  • Train dispatcher
  • Signal operator
  • Switch operator
  • Train manager
  • Shunter
  • Yard worker
  • Rolling stock inspector
  • Automation technician
  • Track master
  • Level crossing keeper
  • Conductor
  • Technical service and cleaning staff forming part of the train crew

As a result, for example, train drivers and train managers employed by Warsaw’s Szybka Kolej Miejska, while carrying out their duties related to the provision of transport services, are now covered by this legal protection.
